The Owner-Operator Independent Drivers Association (OOIDA)’s last stand to try and repeal the ELD mandate has been denied by the U.S. Supreme Court for good.

In previous news, OOIDA had lost their case when the 7th Circuit Court of Appeals had ruled in favor of keeping the ELD mandate in effect for the December 17th, 2017 deadline. The court had decided that OOIDA’s argument, which stated drivers would not be sufficiently protected against unlawful search and seizure, did not violate truckers’ 4th amendment rights.

Other Reasons Why the ELD Mandate Appeal Would Have Failed

Since the Seventh Circuit Court is just one level below the U.S. Supreme Court, the likelihood of OOIDA’s case against the ELD mandate being appealed was unlikely to begin with. The Supreme Court, on average, receives around 8,000 requests per year and only hears around 70-80 of them. In the event a case IS petitioned, a decision is usually not made until a year later anyways.

OOIDA has publicly expressed their dissatisfaction, stating they are “extremely disappointed that the Supreme Court does not see the merit in reviewing our case with so many questions about its constitutionality.”

Despite their persistence, it is now safe to say OOIDA’s attempt to revoke the ELD mandate has come to a grinding halt. So what now?
